Svlad Cjelli Certainly looks like he's trying to provoke them as much as possible - presumably to release him from the contract.

There must be a breach of contract penalty on his side Shirley?

Maybe - but not sure it'd be punitive.

If it was a penalty, it would be unenforceable...

I'd imagine the penalty would be having his contract cancelled with no further payments - which presumably is exactly what he wants most.

Are footballers independent contractors or employees ?

There seems to be a lot of blurring of the distinction

Couldn't they hold on to his registration in those circumstances? Alternatively, if Citeh terminated the contract because of his breach and lost the ability to sell him (because they couldn't retain the registration), I guess that Tevez would be liable for Citeh's loss (ie his transfer value), subject to there being clauses in the contract to the contrary.

Before Bosman yes, but I'm not sure these days. Would depends on terms of contract as you say, but I feel it might need to go to court to be resolved. If so, any sensible club would recognise the fight's not worth the hassle and tell him to piss off and never come back.

Agreed. Although I do believe that Man City officially have more money than sense (as Chelsea did with Mutu...).

The gift that keeps on giving £150k per week?

http://news.bbc.co.uk/sport1/hi/football/15727644.stm

Carlos Tevez's advisors have told BBC Sport the striker is still in Argentina after again failing to attend training at Manchester City on Monday.

City say that Tevez, 27, was not granted leave last week and should have stayed with the Premier League leaders throughout the international break.

They instructed their lawyers to take action following last week's absence.

His advisors also claimed they had not been informed of any disciplinary proceedings resulting from his actions.

Reports suggested that the player has a medical certificate which states he is unable to train or play, although his spokespeople could not confirm that.

Sue him for breach of contract or continue fining him

Simon Grayson says Andy O'Brien will never play for Leeds again

Leeds United's Andy O'Brien O'Brien (right) joined Leeds from Bolton in October 2010

Leeds manager Simon Grayson says Andy O'Brien refused to play in the win over Burnley and will never appear for the club again.

Grayson said the defender, who has been heckled by supporters, told him on Friday he did not want to play against the Clarets.

"It came as a shock, especially after I have backed him publicly and privately over the last few weeks," Grayson said.

"He won't play for this football club again as long as I am here."

the distance isn't the issue. His wife doesn't like Manchester, so won't move there. If he moves somewhere more appealing, she is likely to go with him to live, negating this whole Tevez in Argentina saga

They should now sell him to Chelsea so he'd be guaranteed a return to Manchester at least twice a year...
