Tony Le Mesmer West Ham have been informed that they can not take their case to the court of appeal. Can see this running and running before being settled out of court.


I wonder if Sheffield United would settle out of court though. If they're entitled to around £30m, West Ham will only offer less out of court anyway so what would be the point in Sheffield United going soft and getting less?

Take 'em for every penny you can!

West Ham have no recourse to the courts - they signed away their legal rights when they agreed to the arbitration tribunal.

And the Court of Arbitration for Sports has just said they would not be able to hear an appeal unless they had the agreement of Sheffield United (not very likely), and the FA rules allowed it. Which they don't ("the parties shall be deemed to have waived irrevocably any right to appeal, review or any recourse to a court of law").

And the Court of Arbitration for Sports has just said they would not be able to hear an appeal unless they had the agreement of Sheffield United (not very likely), and the FA rules allowed it. Which they don't ("the parties shall be deemed to have waived irrevocably any right to appeal, review or any recourse to a court of law").

But I don't think the Court of Arbitration for Sport is a court of law and therefore the FA rules don't come into it in terms of whether or not they can appeal.

West Ham should call John Madejski as a witness to confirm that you don't make any money by being in The Premiership, therefore, Sheff Utd are entitled to no compensation.

West Ham cheated, surely in a court of law ignorance is no defence, they would be better to pay the £30 million and move on, if they continue to push this they might find that they lose even more, any solicitor will advice trying to pay less.

How much did they receive for Tevez in the end, I thought they got compo off man u , i might be wrong.

Personally I think that they should be relegated or should have been, probably too late for this to happen now, so a 20 point reduction for NEXT season as punishment from the FA.

Lol out all the journalists trying to liken Sheff Utd to Watford suing becasue of the goal that never was.

The differnece is West Ham knowingly and imo in colaberation with the Premier League lied and cheated time after time.

Still can't believe what happened. How could anyone with half a brain cell tink that MSI would just agree to rip up Tevez's contract and hand over ownership to West Ham? Why would MSI do that? Why is Tevez on loan at Man Utd, if West Ham owned him they would have demanded £30m plus. The Premier Leage were clearly aware of what was happening and that's the most sickening part of it all.

Still expect article after article from West HAm supporting 'journalists' telling us all how Sheff Utd are just being greedy and this is all part of a compensation culture that sets an example that will ruin football.

After all, to do otherwise would suggest some form of cover-up and I am sure such a high-minded campaigner for justice would never be party to that.

Martin Samuel's West Ham-supporting has really come to the fore here - he's not exactly defended them but it's been non-stop attack on Sheff U.

Your club scarf is handed in at the door in exchange for a press pass on your first day in this job. My view, published immediately after the Premier League commission reported, was that West Ham should not have been deducted points, but should have been relegated, if justice were to be done. I still believe that is what should have happened at the time. Scott Duxbury should no longer be an executive of the club, either.
